Short-term leases: basic requirements
As of January 1, 2024, new regulations regarding short-term rentals of real estate for less than 100 days came into force in Turkey.
Long-term rentals (101 days or more) are not subject to this law.
The main provisions of the law:
- Short-term rentals require a license from the Ministry of Culture and Tourism
- The license is issued through the e-devlet portal or by power of attorney through a Turkish citizen. The period for obtaining the license varies from one to three months and the cost is 12,700 Turkish Liras.
Consent of all homeowners
- To obtain a license, the consent of all building owners is required. In multi-building complexes, the consent of the owners of the building where the apartment to be rented is located is sufficient.
- In buildings with separate infrastructure, 100% consent is not required, but the management plan of the complex must include the possibility of short-term rentals. Changes to the complex's bylaws require the approval of 4/5 of the owners.
Prohibition on subletting
- The law prohibits subletting, i.e. you cannot rent a dwelling for a long period of time and then rent it out for short periods.
Installation of signage
- After obtaining a license, a sign from the Ministry of Tourism must be installed at the entrance to the rented accommodation. Inspections of the properties will be carried out by government inspectors.
Impact on the rental market
- The new law increases the transparency of short-term rentals, reduces the number of illegal properties, improves control over the quality of services provided and ensures the safety of tenants. For investors, it may lead to less competition and higher returns on their investments.
